01The agreement
These Terms & Conditions (“Terms”) form a binding agreement between you and Nabla Technology Co., Ltd. (“VideoGen”, “we”, “us”) covering your use of the VideoGen website, the creator app, and any related features (together, the “Service”). By creating an account or using the Service you agree to be bound by these Terms and our Privacy Policy.
02Eligibility & account
You must be at least 13 years old (or the digital-consent age in your country, whichever is higher) to use the Service. If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.
You are responsible for the activity that happens under your account. Keep your password confidential, do not share access credentials, and notify us immediately if you suspect unauthorised use.
03The service
VideoGen lets you generate, edit, and export AI-produced images and videos. The Service includes Text-to-Video, Image-to-Video, Text-to-Image, and Image-to-Image generation, along with access to a curated library of third-party AI models.
We are continually improving the Service and may add, modify, or remove features. We will give reasonable notice before retiring features that you actively rely on.
04Plans, credits & payment
- Free tier — limited starter credits with no payment required. Personal use only.
- Paid subscriptions — billed monthly at the price shown on the Pricing page. Credits refresh on each renewal.
- Credit packs — one-time purchases that stack on top of any plan. Credits never expire while the account is active.
- Auto-renewal — subscriptions renew automatically at the end of each billing cycle until you cancel. You can cancel anytime from your account settings.
- Refunds — see our Refund Policy.
- Taxes — prices may exclude applicable VAT, GST, or sales tax, which will be added at checkout where required.
05Your content
“User Content” means any prompt, text, image, audio, or video that you upload, paste, or otherwise feed into the Service. You retain ownership of your User Content. You confirm that you have the rights to use the material you upload and that doing so does not infringe anyone else’s rights.
06Ownership of generated output
Subject to your compliance with these Terms and the underlying model provider’s terms, you own the output that the Service produces from your prompts and uploads (“Generated Output”). On paid plans you may use Generated Output for personal and commercial purposes, including monetised social media, advertising, and merchandise.
The free tier is for non-commercial personal use only. Commercial rights begin from your first paid plan or credit pack purchase.
07License you grant us
To deliver the Service, you grant VideoGen a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your User Content and Generated Output. This license exists only so we can run the generation pipeline, store your work in your private workspace, and provide support. We do not use your content to train shared models without your explicit opt-in.
08Acceptable use
No illegal content, no targeted harassment, no sexual content involving minors, no deceptive deepfakes of real people without consent, no scraping or automated abuse of the Service.
09Third-party models & services
The Service routes some generations to models hosted by third parties (for example, well-known image and video providers). Their separate terms apply to the work that runs on their infrastructure, particularly around prohibited prompts and commercial-use rights. We pass on the relevant restrictions in the model picker; please respect them.
10Our intellectual property
The VideoGen brand, software, UI, animations, copy, and house-trained models are owned by Nabla Technology Co., Ltd. or our licensors. We grant you a limited, revocable, non-transferable license to use the Service in accordance with these Terms. No other rights are granted by implication.
11Disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the Service will be uninterrupted, error-free, or generate any specific result.
12Limitation of liability
To the maximum extent permitted by law, VideoGen, our affiliates, and our suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) USD 100.
13Indemnity
You agree to defend and indemnify VideoGen against any claim, loss, or expense (including reasonable legal fees) arising from your User Content, your use of Generated Output, or your breach of these Terms.
14Suspension & termination
You can close your account at any time from account settings or by contacting support. We may suspend or terminate access if you breach these Terms or if we are required to do so by law. Where reasonable we will give notice and a chance to remedy. Sections that by nature should survive termination — including ownership, disclaimers, and limitation of liability — will remain in effect.
15Changes to these terms
We may update these Terms from time to time. If a change is material we will notify you in product or by email at least 14 days before it takes effect. Continued use of the Service after the effective date constitutes acceptance.
16Governing law & disputes
These Terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-law principles. Disputes that cannot be resolved through good-faith negotiation will be submitted to the competent courts in Chongqing, China. Nothing in this section limits any non-waivable consumer rights you may have under your local law.
